Allahabad High Court

DEVENDAR KUMARversusMOTOR ACCIDENT CLAIM TRIBUNAL, NORTHERN MEERUT AND 2 OTHERS

Decided

Holding

The Court directed the Motor Accident Claim Tribunal to decide the pending MACP No. 301 of 2024 within six months, without deciding the merits of the claim.

Summary

Petitioner Devendar Kumar filed a writ petition seeking a mandamus directing the Motor Accident Claim Tribunal (Northern Meerut) to conclude MACP No. 301 of 2024 within a fixed period. The petition argued that the claim had been pending since 2024 and further delay served no useful purpose. The Court observed the pendency and, without adjudicating the merits of the underlying claim, issued a direction that the Tribunal decide the matter within six months of the order. The direction was to be complied with after hearing all parties in accordance with law. Consequently, the writ petition was disposed of, with the Court emphasizing that it had not decided the substantive issues of the case.

Issues considered

  • Whether the High Court can prescribe a specific time‑frame for the Tribunal to decide the matter

                                                        HON'BLE ROHIT RANJAN AGARWAL, J.

                                    1. This writ petition has been filed with the following prayer:-

"1. Issue writ order or direction in the nature of Mandamus commanding/directing the
Motor Accident Claim Tribunal, Northern Meerut to expeditiously conclude and
decide M.A.C.P No. 301 of 2024 (Devendra Kumar versus Cholamandalam MS
General Insurance Co. Ltd. & Another), within such stipulated period as may be fixed
                                    by this Hon'ble Court."

                                    2. It is contended by learned counsel for the petitioner that Motor Accident Claims
Petition is pending consideration since 2024 before Motor Accident Claims Tribunal,
                                    Northern Meerut.

                                    3. As no useful purpose would be served in keeping the matter pending, or calling for
counter affidavit or issuing notice to the private respondents, the matter is being
disposed of, at the admission stage, with a direction upon court concerned to decide
the pending M.A.C.P. No. 301 of 2024 (Devendra Kumar versus Cholamandalam MS
General Insurance Co. Ltd. & Another) after hearing all the concerned parties, strictly
in accordance with law, expeditiously, preferably within a period of six months from
the date of production of certified copy of this order.

                                    4. With the aforesaid direction, present writ petition stands disposed of.

                                    5. It is made clear that this Court has not adjudicated the case on merits.
