Allahabad High Court

MANVEERversusSTATE OF UTTAR PRADESH AND 2 OTHERS

Decided

Holding

The Court directed the CEO of the New Okhla Industrial Development Authority to decide the petitioner's application within two months from the date of the order.

Summary

Manveer filed a writ petition seeking a mandamus directing the Chief Executive Officer of the New Okhla Industrial Development Authority (NOIDA) to consider and decide his application dated 25 August 2026 within the time prescribed by law. The respondents argued that the application could be decided within two months from the date of the hearing. The Court examined whether the statutory authority had a duty to decide the application within a reasonable time and whether a writ of mandamus was appropriate. Relying on principles of administrative law, the Court held that the authority must act within a reasonable period and can be directed by a mandamus. Consequently, the petition was disposed by directing the CEO to decide the application within two months.

Issues considered

  • Whether the Chief Executive Officer of NOIDA is obligated to decide the petitioner's application within a stipulated time under law.
  • Whether a writ of mandamus is the appropriate remedy to enforce timely decision.
