Holding
The court held that adult petitioners are free to live together without interference and granted a permanent injunction and protection order, subject to timely marriage registration.
Summary
Arvind Kumar and another petitioners filed a writ petition seeking a permanent injunction restraining the respondents from interfering in their marital life and requesting police protection, alleging threats from family members after their adult marriage. The petitioners submitted age proof, joint affidavits and an application for marriage registration, asserting that they are adults who married of their own free will. The court, noting that no notice to private respondents was required, relied on Supreme Court precedents that adults have the right to choose their partners without parental or societal interference. It ordered that the respondents refrain from disturbing the petitioners' peaceful cohabitation and directed the senior police officer to provide immediate protection. The court also directed the petitioners to complete marriage registration within two months, after which the protection order would lapse if not complied, and clarified that it made no determination on the validity of the marriage.
Issues considered
- Whether the respondents can be restrained from interfering in the adult petitioners' marital life.
- Whether the court can issue a protection order and permanent injunction in a matrimonial dispute involving adult consent.
- Whether the petitioners must register their marriage within a stipulated period for the protection order to remain effective.

Court No. - 75
HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari
Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P.
and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
(supra) has held as under:
"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."
(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani
