Allahabad High Court
YOGENDRA SINGHversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The appointment of Sahayak Vikas Adhikari as Administrator is valid, non‑prejudicial to the petitioner, and not arbitrary.
Summary
The petitioner, an outgoing member of a Gram Panchayat, challenged a High Court order that appointed Sahayak Vikas Adhikari as an Administrator to exercise administrative powers after the outgoing Gram Pradhan's powers were seized. The court held that the appointment was a temporary measure pending new elections and that the Administrator’s role was limited to administrative functions without any financial authority. It found no legal error in the appointment, noting that the petitioner was not prejudiced as the order did not affect financial powers. The court further observed that there was no arbitrariness in the order. Consequently, the writ petition was dismissed.
Issues considered
- Whether the appointment of Sahayak Vikas Adhikari as Administrator of the Gram Panchayat is legally valid.
- Whether the petitioner, as an outgoing Gram Panchayat member, suffers prejudice from the appointment.

Ravindra Kumar Tripathi, learned Standing Counsel for State-
Respondents.
2. The challenge is made to an order dated 01.06.2026 at the behest of
petitioner, a Member of outgoing Gram Panchayat, that since powers of
outgoing Gram Pradhan is already seized and an alternative arrangement
is made by appointing Sahayak Vikas Adhikari as an Administrator to
exercise administrative powers, therefore, an Administrator can only be a
Three Members Committee from elected Members.
3. However, the Court finds that it is only a temporary arrangement till
new elections are conducted and the only work of Administrator is to take
care of administrative works. Sahayak Vikas Adhikari is a responsible
officer and is aware about the working of Gram Panchayat. Therefore,
there is no legal error if said Officer is appointed as an Administrator.
There is no circumstance exist that petitioner, being a Member of
outgoing Gram Panchayat is prejudice by impugned order since the only
work is of administration and no financial power can be exercised.
Therefore, impugned order which is based on reasons cannot be
