Allahabad High Court

JITENDRA PALversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court ordered that, in the absence of any legal impediment, the licence application be decided expeditiously.

Summary

Petitioner Jitendra Pal filed a writ petition seeking the court's intervention to expedite his application under Rule 25 of the Arms Rules, 2016 for a licence to be granted to a legal heir. The petition was argued by counsel Ashish Srivastava, while the State of U.P. and other respondents were represented by C.S.C. The court noted that the prayers in the writ petition were not precisely framed but, considering the urgency, decided to address the matter. It directed that the application be decided expeditiously provided there is no legal impediment. No substantive merits of the licence application were examined; the court merely ordered the administrative authority to process it without delay.

Issues considered

  • Whether the writ petition can be entertained to direct the expeditious disposal of an application under Rule 25 of the Arms Rules, 2016
  • Whether any legal impediment exists to granting the licence to the legal heir
