Allahabad High Court

ARCHANA AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition was dismissed as it was not maintainable because it was filed with a single affidavit and not a proper pleading.

Summary

Petitioners Archana and another filed a writ petition seeking a permanent injunction restraining the respondents, the State of U.P. and three others, from interfering in their live‑in relationship and requesting police protection. The petition was supported only by a single affidavit and lacked a proper pleading. Respondents argued that the petition was not maintainable for this reason. The Court examined the filing and held that a petition filed solely on an affidavit is not a valid writ petition. Consequently, the petition was dismissed for lack of maintainability.

Issues considered

  • Whether a writ petition filed with only a single affidavit and without a proper pleading is maintainable.
  • Whether a permanent injunction can be granted to protect a live‑in relationship in the absence of a maintainable petition.

Subjects

  • live-in relationship
  • injunction
  • writ petition
  • maintainability
  • affidavit
  • permanent injunction
