Allahabad High Court

SMT. ANJALI PATEL AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that adult petitioners are free to live together and may be protected from interference, granting a protection order subject to conditions.

Summary

Petitioners Anjali Patel and another, both adults, filed a writ petition seeking a permanent injunction restraining the respondents, including members of their families and the State of U.P., from interfering in their marital life and requesting police protection due to alleged threats. They submitted school certificates and an application for marriage registration to demonstrate their age and intent to marry. The Court, relying on Supreme Court precedents affirming the right of adults to cohabit without parental interference, ordered that no one may disturb their peaceful existence and directed the senior police officer to provide immediate protection. The petitioners were directed to complete marriage registration within two months, failing which the protection order would lapse. The Court clarified that it made no determination on the validity of the marriage itself.

Issues considered

  • Whether adult petitioners are entitled to a protection order against family members interfering in their marital life

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari

and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
