Allahabad High Court

M/S INFINITE ENTERPRISESversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court allowed the petition by staying the auction, directing the petitioner to pay Rs 5 lakh as a first installment and the balance in quarterly installments, subject to compliance.

Summary

The petitioner, Infinite Enterprises, challenged a possession‑cum‑sale notice issued by Punjab National Bank demanding repayment of Rs 17,30,271.09. The petitioner offered to pay 25% of the amount before the scheduled auction on 18‑09‑2026 and the balance in installments, seeking a stay of the auction. The bank did not oppose the proposal. The Court, after considering the facts, directed the petitioner to deposit an initial Rs 5 lakh by 18‑09‑2026, after which the bank must furnish a detailed account statement and a schedule of installments. The balance is to be paid in three equal quarterly installments starting 01‑01‑2027, with no recovery charges if complied with. Failure to comply would automatically vacate the order and revive recovery proceedings. The petition was disposed with these directions.

by the petitioner through the remaining three equal quarterly installments
