Allahabad High Court

PRIYA DEVI AND ANOTHERversusSTATE OF UTTAR PRADESH AND 5 OTHERS

Decided

Holding

The petitioners are not entitled to the relief sought and the petition is dismissed.

Summary

The petitioners, Priya Devi and another, filed a writ seeking a permanent injunction restraining the respondents and their families from interfering with the petitioners' live‑in relationship and requesting police protection. The petitioners submitted age proof and joint affidavits asserting their consensual adult relationship and alleged threats to their life. The respondents argued that one petitioner is already married and has not produced any divorce decree, contending that the petition lacks merit. The court, relying on the precedent Asha Devi & Another v. State of U.P. (Writ C‑No. 18743 of 2020), found no justification to grant the relief and dismissed the petition without further comment.

Issues considered

  • Whether adult petitioners are entitled to a permanent injunction preventing interference in their live‑in relationship.
  • Whether the petitioners have demonstrated a credible threat to life warranting police protection.
  • Whether the marital status of one petitioner bars the claim for protection.
  • Whether the precedent set in Asha Devi & Another v. State of U.P. applies to deny the relief.

Subjects

  • live-in relationship
  • injunction
  • protection order
  • domestic violence
  • marital status
  • precedent
