Allahabad High Court

SMT DIVYA AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult petitioners who are sui juris cannot be restrained from cohabiting, and the court may grant a permanent injunction and direct police protection to prevent interference.

Summary

The petitioners, Smt Divya and another, filed a writ seeking a permanent injunction restraining the respondents from interfering in their marital life and directing police protection. The court examined the petitioners' age, consent, marriage registration, and alleged threats from family members, concluding that they are adults capable of making independent choices. Relying on Supreme Court precedents that protect the liberty of adult individuals to cohabit, the court held that no one, including parents or relatives, may obstruct their peaceful domestic life. Consequently, the court ordered that the respondents refrain from any interference and directed the senior police officer to provide immediate protection to the petitioners. The order does not comment on the validity of the marriage but merely safeguards the petitioners' right to live together without harassment.

Issues considered

  • The respondents' right to intervene in the marital/cohabitation life of adult petitioners.
  • Whether a permanent injunction can be granted to prevent such interference.
  • Whether the court can direct police protection for the petitioners.
  • The relevance of the petitioners' marriage registration to the relief sought.

Subjects

  • marriage
  • adult consent
  • personal liberty
  • permanent injunction
  • police protection
  • right to cohabit
  • Supreme Court precedent

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The
Superintendent, Nari Niketan, Delhi and others, (1976) 3 SCC 234; Lata
Singh v. State of U.P. and another, (2006) 5 SCC 475; and Bhagwan Dass
                                                                                                    WRIC No. 35786 of 2026
                                                                        2

                                    v. State (NCT of Delhi), (2011) 6 SCC 396, which have consistently been
followed by the Supreme Court and this court, as well as of this Court in
Deepika and another v. State of U.P. And others, 2013 (9) ADJ 534. The
Supreme Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court
or the relatives of the petitioner can also not substitute their
opinion or preference for that of the petitioner in such a matter."

                                                                                         (Dr. Gautam Chowdhary,J.)
