Allahabad High Court

POONAM NISHAD AND ANOTHERversusSTATE OF UTTAR PRADESH AND 5 OTHERS

Decided

Holding

The petition is dismissed; no permanent injunction or protection order is granted.

Summary

The petitioners, two adult individuals in a live-in relationship, filed a writ seeking a permanent injunction restraining the respondents and their families from interfering with their cohabitation and requesting police protection. They submitted age proof and joint affidavits to demonstrate consensual adult relationship. The respondents contended that petitioner No.1 is already married and no divorce decree was produced, implying the petition lacks merit. The court, relying on the precedent Asha Devi and Another v. State of U.P. (Writ (C) No. 18743 of 2020), found no justification to grant the relief sought. Consequently, the court dismissed the petition without granting any injunction or protection order.

Issues considered

  • Whether adult petitioners in a live-in relationship are entitled to a permanent injunction protecting their cohabitation under constitutional rights.
  • Whether the alleged marital status of petitioner No.1, without proof of divorce, defeats the petitioners' standing to claim protection.
  • Whether the court should issue a protection order against the respondents and their families.

Subjects

  • live-in relationship
  • permanent injunction
  • right to life and liberty
  • marital status
