Allahabad High Court

PRAVIN SINGHversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court ordered that the Appellate Authority consider the stay application within four weeks and decide the appeal within six months.

Summary

Petitioner Pravin Singh filed an appeal under Section 56 of the Indian Stamp Act, 1899, together with a stay application, alleging that the stay application had not been decided. The petitioner sought expeditious consideration of the stay. The High Court noted the delay and, without deciding the stay itself, disposed of the writ petition. The Court directed that the Appellate Authority should consider the stay application within four weeks and decide the appeal within six months. No substantive order on the merits of the stay was made, but the Court emphasized prompt procedural action.
