Allahabad High Court
SUBHASH CHANDRA KUSHWAHAversusSTATE OF U.P. AND 8 OTHERS
- Decided
Holding
An order seizing the powers of a Pradhan whose tenure has expired has no legal consequence.
Summary
The petitioner, Subhash Chandra Kushwaha, challenged an order that seized his financial and administrative powers as Pradhan. The Court noted that his tenure had already expired, rendering the impugned order without legal effect. It further observed that recent Government Orders dated 25.04.2026 and 29.04.2026 require outgoing Pradhans to perform only administrative duties until new elections are held. Consequently, the petitioner’s status is governed by these orders, subject to any other legal impediment. The writ petition was therefore dismissed as moot.

HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard learned counsel for petitioner and learned Standing Counsel for
State-Respondents.
2. Admittedly, present tenure of petitioner as Pradhan has already come to
an end, therefore, effect of impugned order, whereby petitioner's financial
and administrative powers were seized has now no legal consequence.
3. The Court also takes note that presently, there are Government Orders
dated 25.04.2026 and 29.04.2026 in operation whereby outgoing
Pradhans are required to do only administrative work till fresh elections
are conducted, which also governs status of present petitioner also,
subject to any other legal impediment.
4. With aforesaid observation, this writ petition is disposed of.
