Allahabad High Court

SMT RITIKA SONKAR AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult consenting individuals have an absolute right to live together without interference, and the court may grant protective orders to enforce that right.

Summary

The petitioners, Ritika Sonkar and her partner, filed a writ petition seeking a permanent injunction and police protection to prevent family members from interfering with their consensual adult marriage. They submitted proof of age, affidavits, and an application for marriage registration, alleging threats and intimidation from private respondents. The court, noting that both parties are sui juris adults, held that no one has the right to interfere with their peaceful cohabitation and ordered the police to provide immediate protection. It also directed the petitioners to complete marriage registration within two months, after which the protection order would lapse if not complied. The court clarified that it made no determination on the validity of the marriage itself and dismissed the petition with the protective order in place.

Issues considered

  • The court can issue a protection order to prevent interference in the marital life of adult consenting parties.
  • Whether notice to private respondents is required in such a writ petition.
  • Whether the petitioners must register their marriage within a stipulated period for the protection order to remain effective.

Subjects

  • protection order

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                                        WRIC No. 35939 of 2026
                                                                           2

Gian Devi v. The Superintendent, Nari
Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P.
and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
