Allahabad High Court

MOHNI AND ANOTHERversusSTATE OF UP AND 4 OTHERS

Decided

Holding

The court held that adult petitioners are free to live together and may be protected from interference, granting a protection order but not deciding on the marriage's validity.

Summary

Petitioners Mohni and another, an adult couple, filed a writ petition seeking a permanent injunction restraining the respondents from interfering in their peaceful marital life and directing police protection. They submitted proof of age, affidavits, and an application for marriage registration, alleging threats and harassment from private respondents and family members. The court, relying on Supreme Court precedents that adult individuals may cohabit and marry without parental interference, held that no one may obstruct their marital relationship. Accordingly, it ordered the respondents to refrain from interference and directed the senior police officer to provide immediate protection, while also directing the petitioners to register their marriage within two months, failing which the protection would lapse. The court clarified that it made no determination on the validity of the marriage itself.

Issues considered

  • Whether a permanent injunction can be issued to prevent respondents from interfering in the petitioners' marital life
  • Whether the court can direct police protection for the petitioners
  • Whether the petitioners must register their marriage within a specified period as a condition of protection
  • Whether the court can grant relief without adjudicating the validity of the marriage

Subjects

  • permanent injunction
  • marital freedom
  • adult consent
  • police protection
  • marriage registration
  • family dispute
  • civil writ

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari

and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
