Allahabad High Court

VISHAL SINGHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The writ petition is dismissed with a cost of Rs.10,000 and no contempt proceedings are ordered.

Summary

Petitioner Vishal Singh filed a writ petition alleging that despite orders of the RERA authority, the respondent had not transferred possession of a flat or released funds, claiming he had deposited money but was denied possession. The petitioner later testified that he had actually taken possession of the flat on 09-10-2023 and that the sale deed was executed in his favour. The Court found that the petitioner had made false and misleading statements in the petition. Consequently, the Court dismissed the petition, imposed a cost of Rs.10,000, but refrained from initiating contempt proceedings. The petitioner was directed to pay the cost within two weeks and to furnish receipt to the District Magistrate within three weeks.

Issues considered

  • Whether the petitioner’s allegations of non‑possession and non‑payment despite RERA orders are true.
  • Whether the writ petition should be dismissed on account of false statements made by the petitioner.
  • Whether contempt proceedings should be ordered against the petitioner.
