Allahabad High Court
SMT. MEERA DEVI AND 2 OTHERSversusSTATE OF U.P. AND 2 OTHERS
- Decided
Holding
The court ordered that the pending case and any other similar cases be decided expeditiously in accordance with law.
Summary
Petitioners filed a writ petition under Section 10(2) of the Uttar Pradesh Imposition of Ceiling on Land Holdings Act, 1960, seeking an expeditious decision in the pending criminal case State vs. Mammu alias Ramdevi (Case No. 513 of 1976-77). The petition argued that undue delay in adjudicating the case violated statutory timelines. The High Court, after hearing counsel for both sides, observed that the pending case, along with any other similar cases, should be decided promptly in a chronological manner as per law. No substantive merits of the criminal case were examined; the court focused solely on procedural expeditiousness. Consequently, the writ petition was disposed of with an order directing the respondent authorities to expedite the disposal of the referenced case and any other pending matters.
