Allahabad High Court
COMMITTEE OF MANAGEMENT, RAGHUKUL JUNIOR HIGH SCHOOL AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The court ordered the respondents to consider including the petitioner’s institution in the grant‑in‑aid list under the 1978 Act, after affording a hearing if required.
Summary
The Committee of Management of Raghukul Junior High School filed a writ petition seeking inclusion of the school in the grant‑in‑aid list for payment of salaries to teachers and staff. The petitioners argued that under the U.P. Recognized Basic Schools (Junior High School) (Payment of Salary of Teachers and other Employees) Act, 1978, the school was entitled to such assistance. The respondents, the State of U.P. and other officials, contended that the inclusion required compliance with procedural requirements. The High Court, after hearing the petitioners' counsel and the respondents' standing counsel, directed the respondents to consider the inclusion of the school in the grant‑in‑aid list in accordance with the Act, after providing an opportunity of hearing if necessary. The court disposed of the writ petition with this observation.
