PRIYANKA DEVI @ PRIYANKA SINGHversusBOARD OF REVENUE UP AND ANOTHER
- Decided
- Bench
- VINOD DIWAKAR
Holding
The court directed the Board of Revenue to decide the stamp appeal within six weeks, subject to the petitioner depositing one‑third of the amount.
Summary
The petitioner, Priyanka Devi, filed a writ petition seeking a mandamus directing the Board of Revenue, Prayagraj, to decide her pending Stamp Appeal No. 997 of 2017. The petitioner alleged that the Board had not rendered any final decision despite the appeal being pending for years. The court examined whether it could issue a direction compelling the Board to adjudicate the appeal within a reasonable time. It held that the Board could be directed to decide the appeal expeditiously, but conditioned the order on the petitioner depositing one‑third of the disputed amount. Accordingly, the court ordered the Board to decide the appeal within six weeks of the certified copy of the order, failing which the appeal would be decided as per the regular roster. The petition was disposed with the said direction.
