Allahabad High Court

PUSHPA DEVIversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the petitioner is entitled to correction of the date of birth and husband's name in the marksheet and ordered the correction to be made within four weeks.

Summary

The petitioner, Pushpa Devi, filed a writ petition seeking correction of her date of birth and her husband's name in her High School marksheet (Roll No. 4205352) issued by Durgdeo Janta Inter College, Jaunpur. She alleged that the marksheet incorrectly recorded her birth date and husband's name despite her application to the college in 2012 and a subsequent directive from the District Inspector of Schools in 2023. The Court examined the petition and the relevant circulars of the Madhyamik Shiksha Parishad, finding that the petitioner satisfied the criteria for correction. It held that the delay in filing the representation could be condoned. Consequently, the Court directed the respondents to correct the marksheet within four weeks of receiving the certified order.

Court No. - 38
                     HON'BLE VINOD DIWAKAR, J.

1. Heard learned counsel for the petitioner, learned Standing Counsel for the
State, and perused the record.

2. The present petition has been preferred seeking a direction to respondent
no. 2 to correct the date of birth of the petitioner as 06.04.1977, in place of
the incorrectly recorded date of birth, in the High School marksheet (Roll
No. 4205352) for the year 2012, and to issue a corrected marksheet and
certificate within a reasonable time. A further direction is sought for
correction of the entry with respect to the husband's name, as raised in the
application submitted to the Principal, Durgdeo Janta Inter College,
Gaddopur, Jaunpur, on 13.10.2012, annexed at page 26 of the writ petition.

3. The case of the petitioner is that she was born on 06.04.1977, and passed
5th class in the year 1988 from Prathmik Vidyalaya, Shivpur, Sirkoni,
District Jaunpur. She subsequently passed Junior High School from Junior
High School, Nehru Nagar, Jaunpur, in the year 1991, and thereafter passed
High School in the year 2012 from Durgdeo Janta Inter College, Gaddopur,
District Jaunpur, bearing Roll No. 4205352. However, an incorrect date of
birth, as well as an incorrect entry of the husband's name, came to be
recorded in the High School marksheet. The petitioner, therefore,
approached respondent no. 3 by means of an application dated 13.10.2012,
but no action was taken thereon. Left with no option, the petitioner further
approached the Regional Secretary, Madhyamik, on 16.08.2013. Thereafter,
the District Inspector of Schools (DIOS), Jaunpur, issued a letter dated
09.06.2023, addressed to all the Principals of the district, directing correction

                                                                      2

of the date of birth in similar cases; however, the same has not been
complied with in the case of the petitioner till date.

                                    4. Having heard learned counsel for the petitioner and perused the material
on record, this Court finds that the petitioner fulfils the criteria for correction
of the date of birth and the husband's name, as recognized and permitted
under the relevant circulars of the Madhyamik Shiksha Parishad.

                                    5. Accordingly, the present writ petition is disposed of with a direction to
respondent nos. 2 and 3 to do the needful in terms of the contentions raised
by the petitioner herein, and to correct the date of birth as 06.04.1977, as
well as the entry regarding the husband's name, in the High School
marksheet/certificate (Roll No. 4205352). If any delay has occasioned in
preferring the representation/application for correction, the same shall stand
condoned, and the correction as directed above shall be carried out within a
period of four weeks from the date of receipt of a certified copy of this order.

                                    September 16, 2026
