Allahabad High Court

SMT. GUNJA AND ANOTHERversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The court held that a permanent injunction cannot be granted to protect a live-in relationship where one party is already married, as it would be contrary to the Indian Penal Code provisions on bigamy.

Summary

The petitioners, Smt. Gunja and another, filed a writ petition seeking a permanent injunction directing the respondents, the State of Uttar Pradesh and others, not to interfere in their marital life and to provide them protection. The petitioners alleged they were in a live-in relationship and claimed a right to protection. The respondents contended that one petitioner was already married and living with another partner without a divorce, making the relationship illegal under the Indian Penal Code. They argued that granting any protection would contravene IPC sections 494 and 495, which criminalize bigamy. The court noted that a permanent injunction cannot be issued to override statutory provisions, citing the earlier decision in Asha Devi v. State of U.P. The petition was therefore dismissed for lack of merit.

Issues considered

  • Whether a permanent injunction can be granted to protect a live-in relationship where one party is already married.
  • Whether granting such protection would violate the Indian Penal Code provisions on bigamy (IPC §§494, 495).
  • Whether the court may issue an order that is contrary to existing statutory law.

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                              WRIC No. 37480 of 2026
                                                                     2
