Allahabad High Court

KAMLESH AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that no permanent injunction can be granted as it would be contrary to law and the petition lacks merit.

Summary

Petitioners Kamlesh and another filed a writ petition seeking a permanent injunction restraining the State of Uttar Pradesh and others from interfering in their marital life and requesting police protection. The respondents argued that petitioner No.1 is already married and is in a live‑in relationship with petitioner No.2 without having obtained a divorce, making the relationship violative of IPC sections 494 and 495. The court held that a permanent injunction cannot be issued to protect a relationship that is contrary to law, as it would defeat the statutory criminal provisions. Citing the earlier decision in Asha Devi v. State of UP (RIT‑No. 18743/2020), the court reiterated that injunctions cannot be granted against penal statutes. Consequently, the petition was dismissed for lack of merit.

Issues considered

  • Whether a permanent injunction can be granted to protect a live‑in relationship where one party is already married.
  • Whether granting such protection would contravene the Indian Penal Code provisions on bigamy (Sections 494 and 495).

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                              WRIC No. 37484 of 2026
                                                                     2

                                                                                     (Dr. Gautam Chowdhary,J.)
