Holding
The court granted the writ, directing respondents not to interfere with the petitioners' marital life and to provide immediate protection, without adjudicating the marriage's validity.
Summary
The petitioners, a married adult couple, filed a writ petition seeking a permanent injunction restraining family members and other respondents from interfering in their marital life and requesting police protection. They submitted their marriage certificate and school certificates to establish that both are adults who married of their own free will. The petitioners alleged threats and harassment from private respondents, claiming a serious risk to their lives. The court, relying on Supreme Court precedents that protect the autonomy of adult individuals in choosing their partners and residence, ordered that no one may disturb their peaceful cohabitation and directed the respondents to provide immediate protection. The court clarified that it is not passing any judgment on the validity of the marriage, merely ensuring the petitioners' safety and liberty.
Issues considered
- Whether a writ court can issue a protection order (permanent injunction) to prevent family members from interfering in the marital life of adult petitioners.
- Whether the petitioners are entitled to police protection in view of alleged threats to their life.
- Whether the court needs to decide on the validity of the petitioners' marriage in granting the protection order.

HON'BLE DR. GAUTAM CHOWDHARY, J.
Gian Devi v. The Superintendent, Nari Niketan,
WRIC No. 37545 of 2026
2
Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:
"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris no
fetters can be placed upon her choice of the person with whom she is to
stay, nor can any restriction be imposed regarding the place where she
should stay. The court or the relatives of the petitioner can also not
substitute their opinion or preference for that of the petitioner in such a
matter."
