Allahabad High Court

NOSHADversusREGIONAL MANAGER, UTTAR PRADESH STATE ROAD TRANSPORT CORPORATION AND ANOTHER

Decided

Holding

The Court directed the Motor Accident Claims Tribunal to decide the pending MAC case within six months, without adjudicating the merits of the petition.

Summary

The petitioner, Noshad, filed a writ petition seeking a mandamus directing the Motor Accident Claims Tribunal (North, Meerut) to expedite the pending MAC case No. 20/2024. The petitioner argued that the Tribunal had been deliberating the matter since 2024 without any substantive progress, causing undue delay. The Court examined whether it could issue a writ compelling the Tribunal to decide the case within a stipulated time frame, considering the right to speedy justice. It held that while it could not adjudicate the merits of the underlying claim, it could order the Tribunal to dispose of the matter expeditiously. Accordingly, the Court directed the Tribunal to render its decision within six months of the order and disposed of the writ petition without reaching the merits of the case.

Issues considered

  • Whether the High Court can issue a writ of mandamus directing the Motor Accident Claims Tribunal to expedite its pending proceedings.
  • Whether the delay in adjudicating the MAC case violates the petitioner's right to a speedy trial under Article 21 of the Constitution.
