Holding
The High Court directed the Motor Accident Claims Tribunal to decide the pending case within six months and disposed the writ petition without adjudicating its merits.
Summary
The petitioner, Smt. Sangita, filed a writ petition seeking a mandamus directing the Motor Accident Claims Tribunal (North, Meerut) to expedite the pending MAC case No. 246/2024 and decide it within two to three months. The High Court noted that the MAC petition had been pending since 2024 and that further procedural steps such as filing a counter‑affidavit or issuing notice would not serve any useful purpose. The Court therefore ordered the Tribunal to hear all parties and render a decision within six months of the certified copy of the order, without addressing the merits of the underlying accident claim. The writ petition was consequently disposed of. The judgment makes clear that no substantive merits of the accident claim were adjudicated.
Issues considered
- What is the scope of the High Court's power under Article 226 to issue a mandamus directing a statutory tribunal to expedite its proceedings?
