Allahabad High Court

RAM DEV MATHURversusSTATE OF UTTAR PRADESH AND 4 OTHERS

Decided

Holding

The High Court held that writ jurisdiction cannot ordinarily be exercised against a private company, and therefore disposed of the petition with a direction that any claim for unpaid salary be pursued before the insurance company.

Summary

The petitioner, Ram Dev Mathur, filed a writ petition in the Allahabad High Court seeking relief against the State of Uttar Pradesh and others, alleging unpaid salary from a private insurer, PNB Metlife India Insurance Company. No counsel appeared for the petitioner, and the standing counsel for the respondents argued that the writ petition was directed against a private company, which ordinarily falls outside the court's writ jurisdiction. The court noted that while writ jurisdiction is generally unavailable in such cases, it disposed of the petition in the interest of justice, directing that any application to the insurance company regarding unpaid salary be considered by the company in accordance with law, absent any legal impediment. Consequently, the petition was dismissed without further orders. The order was signed by Justice Saurabh Shyam Shamshery on September 18, 2026.
