Allahabad High Court

SMT. POOJA AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult individuals have the right to live together without interference, and the court may grant a protection order directing the police to ensure their safety.

Summary

Petitioners Smt. Pooja and another filed a writ petition seeking a permanent injunction restraining the respondents from interfering in their marital life and directing police protection, alleging threats from family members. They submitted Aadhaar copies to prove they are adults and asserted that they have voluntarily married and are living together. The court, relying on Supreme Court precedents, held that adult individuals are sui juris and no one, including parents or relatives, may interfere with their choice of partner or residence. Accordingly, the court ordered the concerned senior police officer to provide immediate protection to the petitioners and conditioned the protection on the petitioners registering their marriage within two months. The order does not adjudicate the validity of the marriage and will lapse if registration is not completed within the stipulated period.

Issues considered

  • Whether a permanent injunction can be granted to prevent interference in the marital life of adult petitioners
  • Whether police protection can be ordered without notice to the respondents
  • Whether the court can condition the protection order on the petitioners registering their marriage within a specified time

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                WRIC No. 37592 of 2026
                                    2

Gian Devi v. The Superintendent, Nari Niketan,
Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris no
fetters can be placed upon her choice of the person with whom she is to
stay, nor can any restriction be imposed regarding the place where she
should stay. The court or the relatives of the petitioner can also not
substitute their opinion or preference for that of the petitioner in such a
matter."

                                                                                                   WRIC No. 37592 of 2026
                                                                        3

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs
                                    Ashwani Kumar,

                                                                                        (Dr. Gautam Chowdhary,J.)
