Allahabad High Court

SMT GAURI AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult consenting individuals have a right to live together without interference, and a protection order was issued subject to marriage registration within two months.

Summary

The petitioners, Gauri and another adult, filed a writ petition seeking a protection order against family members who were allegedly threatening them for their marriage. The petitioners submitted identity documents and a marriage registration application, asserting that they are adults who have freely married and wish to live together peacefully. The court, relying on Supreme Court precedents that protect the liberty of consenting adults to cohabit, granted a protection order directing the senior police officer to provide immediate security and barred any interference. The order also stipulated that the petitioners must register their marriage within two months, failing which the protection would lapse. The court clarified that it made no determination on the validity of the marriage itself and disposed of the petition.

Issues considered

  • Whether adult individuals have an absolute right to cohabit without interference from family members.
  • Whether a protection order can be issued without notice to the respondents in a writ petition.
  • Whether the court can direct police authorities to provide security to the petitioners.
  • Whether the continuation of protection is contingent upon timely registration of the marriage.

Subjects

  • adult consent
  • cohabitation
  • protection order
  • family interference
  • marriage registration
  • personal liberty

Gian Devi v. The Superintendent, Nari Niketan,
Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris no
fetters can be placed upon her choice of the person with whom she is to
stay, nor can any restriction be imposed regarding the place where she
should stay. The court or the relatives of the petitioner can also not
substitute their opinion or preference for that of the petitioner in such a
matter."

                                                                                                   WRIC No. 37686 of 2026
                                                                        3

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs
                                    Ashwani Kumar,

                                                                                        (Dr. Gautam Chowdhary,J.)
