Holding
The Court ordered the Joint Director of Education to decide the pending notice within four weeks and directed the District Inspector to conduct the election proceedings accordingly.
Summary
The Committee of Management of Sanskrit Vardhini Sabha filed a writ petition seeking a mandamus directing the District Inspector of Schools, Muzaffarnagar, to consider their request for fresh election proceedings at Janta Girls Inter College and to act on a notice dated 06.04.2026 that remained pending. The petitioner argued that the notice had not been decided and demanded an expeditious order. The Court examined whether the administrative authority had a duty to decide the notice and whether a writ of mandamus was appropriate to compel action. It held that the respondent, Joint Director of Education, must decide the notice dated 16.06.2026 within four weeks, taking into account the petitioner's reply. Subsequently, the District Inspector is directed to conduct the election proceedings in a fair and undisputed manner. The petition was therefore disposed with these directions.
Issues considered
- Whether a writ of mandamus can be issued to compel the Joint Director of Education to decide the pending notice regarding election proceedings.
