Allahabad High Court

MURABBA DEVIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court disposed the petition, directing the respondent to consider the petitioner’s grievance within two months, without issuing a mandamus.

Summary

Murabba Devi filed a writ petition under Article 226 seeking a mandamus directing the State of Uttar Pradesh to disburse the full compensation amount under the Mukhyamantri Krishak Durghatna Kalyan Yojana, along with a weekly penalty of Rs.2500. The petitioner had already submitted a representation to the second respondent on 2 August 2026, which remained pending. The learned Standing Counsel for the respondents expressed no objection to disposing of the petition with a direction to consider the pending representation. The Court, after hearing counsel, ordered that the second respondent examine the grievance raised in the representation and decide it within two months of receiving the certified copy of the order. No mandamus was issued; the petition was disposed with the specified direction.

Issues considered

  • Whether the High Court should issue a writ of mandamus directing the State to disburse compensation under the Mukhyamantri Krishak Durghatna Kalyan Yojana.
  • Whether the petition can be disposed by directing the respondent to consider the pending representation instead of granting the relief sought.
