Allahabad High Court

JAGDISH AND 2 OTHERSversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court set aside the impugned order and restored the matter to the Registrar for a fresh hearing.

Summary

Petitioner No.1, Vice‑President of a society, and Petitioner No.3, appointed Secretary, challenged an order dated 30 June 2025 by the Director/Registrar refusing to confirm the Secretary's appointment. They argued that the order was passed ex parte, without any notice of the hearing, violating natural justice, and relied on the society's bye‑laws permitting the Vice‑President to act in the President's absence and authorising the appointment of a Secretary. The respondents contended that proper procedures were followed. The High Court found that no notice had been served as claimed and that the order was arbitrary. Consequently, the Court set aside the impugned order, restored the matter to the Registrar for a fresh hearing on 24 March 2026, and disposed of the writ petition.

Issues considered

  • Whether the Director/Registrar's order refusing confirmation of the Secretary's appointment was passed without due notice and hearing, violating principles of natural justice.
  • Whether the society's bye‑laws empower the Vice‑President to appoint a Secretary in the President's absence.

Subjects

  • society law
  • appointment of secretary

  • ex parte order
