Allahabad High Court

SMT. RUCHI KUMARI AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that adult petitioners are free to live together and ordered police protection and a restraining order against interference, without adjudicating the marriage's validity.

Summary

Petitioners Ruchi Kumari and her spouse, both adults, married on 07‑09‑2026 and residing in Uttar Pradesh, alleged that private respondents (family members) were threatening and harassing them to prevent them from living together. They filed a writ petition seeking a permanent injunction restraining any interference in their marital life and protection from the police. The Court, relying on Supreme Court precedents that adult individuals have the right to choose their partner and live together without parental interference, ordered that no notice be issued to the private respondents and directed the senior police officer to provide immediate protection to the petitioners. The Court also directed the couple to register their marriage within two months, after which the protection would lapse if not done. No determination was made regarding the validity of the marriage itself, and the petition was disposed.

Issues considered

  • What relief, if any, can be granted to adult petitioners to prevent interference by family members in their marital life?
  • Whether a permanent injunction and police protection can be issued under the writ jurisdiction for an adult couple's personal liberty.
  • Whether the requirement to register the marriage within a stipulated period affects the continuance of the protection order.

Subjects

  • adult marriage
  • personal liberty
  • injunction
  • police protection
  • family interference
  • marriage registration
  • writ petition
  • personal law

                                                                WRIC No. 38271 of 2026
                                    2

Gian Devi v. The Superintendent, Nari Niketan,
Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; और Bhagwan Dass v. State (NCT of
Delhi), (2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice
of the person with whom she is to stay, nor can any restriction
be imposed regarding the place where she should stay. The
court or the relatives of the petitioner can also not substitute
their opinion or preference for that of the petitioner in such a
          matter."

180 Seema (Smt.) Vs. Ashwani Kumar,

                                                                                        (Dr. Gautam Chowdhary,J.)
