Allahabad High Court

SMT PRAGYA AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult persons are free to live together and no one, including family members, may lawfully interfere with their peaceful marital life.

Summary

The petitioners, an adult married couple, sought a permanent injunction restraining the respondents and their families from interfering with their peaceful marital life and requested police protection. They submitted proof of age, marriage registration, and affidavits establishing that both are sui juris adults. The court noted that, under precedent, no parent or relative may impose restrictions on the choice of residence or partner of an adult. Relying on Supreme Court decisions such as Gian Devi and Lata Singh, the court held that the couple is free to cohabit and ordered the concerned police officer to provide immediate protection. The court also clarified that it is not passing any judgment on the validity of the marriage and allowed the respondents to file a recall application if the documents are found to be fabricated.

Issues considered

  • Whether adult individuals can be restrained from cohabiting by family members or respondents.
  • Whether a court may issue a protection order for an adult married couple without notice to the respondents.
  • Whether the petition is maintainable in the absence of any alleged legal violation.

Subjects

  • personal liberty
  • right to live together
  • protection order
  • adult marriage
  • court injunction

                                                                                2

(NCT of Delhi), (2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and another v.
State of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris

to stay, nor can any restriction be imposed regarding the place where she

                                              matter."

                                                                                                    (Dr. Gautam Chowdhary,J.)
