Adult individuals have the right to live together without interference, and the Court may grant a protective order subject to the condition of timely marriage registration.
Summary
Petitioners Lilawati and her spouse filed a writ petition seeking a permanent injunction restraining the State of Uttar Pradesh, other respondents and private family members from interfering in their marital life and requesting police protection, alleging threats and harassment. They submitted proof of age, a joint affidavit, and an application for marriage registration, asserting that they married voluntarily on 21‑08‑2026. The Court, relying on Supreme Court precedents that adult individuals have the right to cohabit without parental or third‑party interference, ordered that no notice be issued to the private respondents and directed the senior police officer to provide immediate protection. The Court conditioned the protection on the petitioners registering their marriage within two months, after which the protection would lapse. No determination was made on the validity of the marriage itself, and the writ petition was disposed without any monetary order.
Issues considered
- Whether adult petitioners are entitled to a protective order preventing interference in their marital life.
- Whether the Court can issue a permanent injunction and direct police protection in such circumstances.
- Whether the requirement of marriage registration within a stipulated period affects the continuance of the protection order.

Gian Devi v. The Superintendent, Nari Niketan,
Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P. and
another, (2006) 5 SCC 475; और Bhagwan Dass v. State (NCT of
Delhi), (2011) 6 SCC 396, which have consistently been followed by the
Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme
Court in Gian Devi (supra) has held as under:
"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice
of the person with whom she is to stay, nor can any restriction
be imposed regarding the place where she should stay. The
court or the relatives of the petitioner can also not substitute
their opinion or preference for that of the petitioner in such a
matter."
180 Seema (Smt.) Vs. Ashwani Kumar,
