Allahabad High Court

SMT. KOMIT SIROHI AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that because Petitioner 1's earlier marriage has not been legally dissolved, the petition for a permanent injunction and protection cannot be granted.

Summary

The petitioners, Komit Sirohi and another, filed a writ seeking a permanent injunction restraining the respondents from interfering in their marital life and requesting police protection. They asserted that both are adults, have voluntarily married, and have submitted school certificates and joint affidavits to prove their age and consent. The respondents contended that one petitioner (Petitioner 1) is still legally married to another person, as the prior marriage has not been dissolved by a decree of divorce, and that the e‑stamp agreement does not constitute a valid dissolution. The court examined the documents and found that the prior marriage of Petitioner 1 remains subsisting under law. Consequently, the court concluded that there is no legal basis to grant the relief sought and dismissed the petition.

Issues considered

  • Whether the prior marriage of Petitioner 1 has been legally dissolved.
  • Whether the petitioners are entitled to a permanent injunction and protection order in view of the alleged subsistence of a prior marriage.
  • Whether an e‑stamp mutual agreement can substitute for a decree of divorce under applicable law.

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                                                         WRIC No. 38385 of 2026
                                                                           2

                                                                                              (Dr. Gautam Chowdhary,J.)
