Allahabad High Court

SMT. ROSHNI PARIHAR AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that adult individuals are free to live together without interference and granted a protection order directing police protection, subject to marriage registration within two months.

Summary

The petitioners, Roshni Parihar and another, filed a writ petition seeking a permanent injunction restraining the respondents from interfering in their marital life and requesting police protection. They submitted school certificates and a marriage registration application to demonstrate that both are adults who have married of their own free will. The respondents consented to the relief sought. The Court, relying on Supreme Court precedents such as Gian Devi and Lata Singh, held that no parent or relative may interfere with the choice of an adult couple and therefore granted the protection order. The Court directed the police to provide immediate security and ordered the petitioners to register their marriage within two months, after which the protection would lapse. No determination was made on the validity of the marriage itself.

Issues considered

  • Whether an adult couple can be protected by a permanent injunction against interference by family members.
  • Whether the Court can direct police protection for the petitioners pending marriage registration.
  • Whether the Court can condition the protection order on timely registration of the marriage.

Subjects

  • Protection order

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari

(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
