Allahabad High Court

KUMARI DEVIversusBRANCH MANAGER UNION BANK OF INDIA

Decided

Holding

The Court held that the petition should be disposed with a direction to the competent authority to consider the grievance and pass a reasoned order within two months.

Summary

The petitioner, Kumari Devi, filed a writ petition under Article 226 seeking a mandamus directing Union Bank of India to release her pension arrears of Rs.1,15,641 with interest for the period April to November 2019. She had previously filed an application on 10 July 2026 with the concerned authority but received no relief. The bank, through its counsel, expressed no objection to the petition being disposed provided the authority considers the grievance and passes a reasoned order. The Court noted that the petitioner had exhausted administrative remedy and that the bank was not contesting the claim. Consequently, the Court disposed of the petition, directing the competent authority to examine the grievance and decide within two months, with a reasoned order. The order does not award the pension directly but mandates administrative action.

Issues considered

  • What relief, if any, is appropriate under Article 226 for a petition seeking release of pension arrears with interest?
  • Whether the court should direct the bank to pay the pension directly or merely order the concerned authority to consider the grievance?
