Allahabad High Court

ANJALI AND ANOTHERversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

Adult petitioners are free to live together and no one may lawfully interfere; a permanent injunction and police protection are ordered.

Summary

The petitioners, Anjali and another adult, filed a writ petition seeking a permanent injunction restraining the State of U.P. and other respondents from interfering in their peaceful marital life, alleging threats from family members. They submitted proof of age, PAN/Aadhaar copies, and a marriage registration to establish that they are sui juris adults who married voluntarily. Relying on Supreme Court precedents that protect the right of adults to choose their partners and cohabit without interference, the Court held that no one, including parents or relatives, may impede their marital life. Accordingly, the Court ordered the respondents not to interfere and directed the senior police officials to provide immediate protection to the petitioners. The Court clarified that it made no determination on the validity of the marriage itself and dismissed the petition without any cost order.

Issues considered

  • The respondents' right to intervene in the marital life of adult petitioners.
  • Whether a permanent injunction and police protection can be granted to prevent such interference.
  • Whether the petitioners' marriage is valid (though the Court declined to decide).

Subjects

  • marriage
  • adult consent
  • right to cohabit
  • injunction
  • protection order
  • family interference
  • writ petition
  • personal liberty

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

                                                                WRIC No. 38676 of 2026
                                    2

Gian Devi v. The
Superintendent, Nari Niketan, Delhi and others, (1976) 3 SCC 234; Lata
Singh v. State of U.P. and another, (2006) 5 SCC 475; and Bhagwan Dass
v. State (NCT of Delhi), (2011) 6 SCC 396, which have consistently been
followed by the Supreme Court and this court, as well as of this Court in
Deepika and another v. State of U.P. And others, 2013 (9) ADJ 534. The
Supreme Court in Gian Devi (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice
of the person with whom she is to stay, nor can any restriction
be imposed regarding the place where she should stay. The
court or the relatives of the petitioner can also not substitute
their opinion or preference for that of the petitioner in such a
          matter."

                                                                                                 WRIC No. 38676 of 2026
                                                                       3

                                                                                       (Dr. Gautam Chowdhary,J.)
