Holding
The court held that no person may interfere with the peaceful marital life of the adult petitioners and directed police protection, without passing any view on the validity of the marriage.
Summary
The petitioners, a married adult couple, filed a writ petition seeking a permanent injunction restraining the respondents and their families from interfering in their peaceful marital life and directing police protection. They submitted proof of age, identity documents, and a registered marriage certificate to establish that both are sui juris adults. The court noted that Supreme Court precedents (Gian Devi, Lata Singh, Bhagwan Dass, Deepika) prohibit any parent or third party from interfering with the choice of an adult to cohabit. Accordingly, the court ordered that no one may disturb the couple’s peaceful existence and directed the senior police officer to provide immediate security. The court also allowed the private respondents to move a recall application if the documents were found to be fabricated, and clarified that it made no determination on the validity of the marriage.
Issues considered

- Whether a permanent injunction and police protection can be granted to safeguard the couple’s peaceful domestic life.

Gian Devi v. The Superintendent, Nari Niketan, Delhi and others, (1976) 3
SCC 234; Lata Singh v. State of U.P. and another, (2006) 5 SCC 475; and Bhagwan
Dass v. State (NCT of Delhi), (2011) 6 SCC 396, which have consistently been
followed by the Supreme Court and this court, as well as of this Court in Deepika and
another v. State of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian
Devi (supra) has held as under:
"Whatever may be the date of birth of the petitioner, the fact remains that
she is at present more than 18 years of age. As the petitioner is sui juris no
fetters can be placed upon her choice of the person with whom she is to
stay, nor can any restriction be imposed regarding the place where she
should stay. The court or the relatives of the petitioner can also not
substitute their opinion or preference for that of the petitioner in such a
matter."
