SANDEEP KUMARversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The Court held that the respondent must take a final decision on the Gram Panchayat's proposal for allotment of a fair price shop expeditiously.

Summary

Petitioner Sandeep Kumar filed a writ petition seeking the allotment of a fair price shop at Village Sikari, Tehsil Rajapur, District Chitrakoot. The Gram Panchayat had approved the proposal in an open meeting and forwarded the documents to the Sub‑Divisional Magistrate on 17‑12‑2025, but the State respondents had not taken a final decision. The State’s standing counsel contended that, absent any legal impediment, the decision would be made expeditiously. The Court noted the submissions and directed the respondents to issue a final decision on the Gram Panchayat’s proposal without undue delay. Accordingly, the petition was disposed with a direction to the respondents to act expeditiously in accordance with law.
