Holding

The writ petition is dismissed as misconceived, without imposing costs.

Summary

The petitioner had earlier approached the High Court for expediting the magistrate proceedings, but the magistrate dismissed the matter when the petitioner was absent. The High Court, after hearing counsel, held that the present writ petition was misconceived and should be dismissed. The order was signed by Judges Prakash Padia and Vivek Saran on 24 September 2026.

1. The petitioner has preferred present writ petition inter-alia with the
prayer to quash the impugned order dated 26.03.2026 passed by the
respondent no.2-Chief Judicial Magistrate, Ghaziabad in Misc. Case
No.3240 of 2025 filed by the petitioner against private respondent nos.3
& 4 and others. The order which is under challenge reads as follows :-

2. From perusal of the record it transpires that petitioner earlier
approached this Court by filing a petition being Writ C No.42608 of 2025
connected with other petitions with the prayer to expedite the hearing of
the case pending before the Chief Judicial Magistrate, Ghaziabad.
                                                                                           WRIC No. 38710 of 2026
                                                                   2

Pursuant to the order passed by this Court when petitioner himself was
not present before the respondent no.2 the matter was dismissed.

                                    3. After hearing counsel for the parties, we are of the opinion that present
writ petition is totally misconceived and liable to be dismissed imposing
                                    exemplary cost.

                                    4. At this point of time, a prayer has been made by counsel for the
petitioner to dismiss present writ petition as not pressed.

                                    5. Taking a lenient view, we are dismissing the present writ petition
                                    without imposing any costs.

                                                                         (Vivek Saran,J.) (Prakash Padia,J.)
                                    September 24, 2026
