Allahabad High Court

VIJAY PAL SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that the petitioner may file a fresh application for an arms license under the applicable rules, provided no legal impediment exists.

Summary

The petitioner, Vijay Pal Singh, reported that his firearm had been stolen and sought to obtain a new licensed firearm. He requested the court to allow him to file an application under Rule 18 of the Arms Rules, 2016, or any other relevant provision, provided there was no legal impediment. The respondent State of U.P. raised no objection to the petition. The learned judge, after hearing counsel, disposed of the writ petition, granting the petitioner liberty to file a fresh application for a new arms license, subject to the absence of any legal bar. No substantive merits of the application were decided, as the court merely directed procedural compliance.
