Allahabad High Court

SMT. NITU AND ANOTHERversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

Adult petitioners are free to live together and marry, and no one may lawfully interfere, warranting a permanent injunction and police protection.

Summary

The petitioners, Nitu and her partner, filed a writ petition seeking a permanent injunction restraining the State of Uttar Pradesh and other respondents from interfering in their marital life and requesting police protection. They submitted proof of adulthood and a pending application for marriage registration, alleging threats and harassment from private respondents and family members. The court, relying on Supreme Court precedents, held that adult individuals have the right to cohabit and marry without interference, and therefore granted the injunction and protection order, directing the senior police officials to provide immediate security. The court also directed the petitioners to complete their marriage registration within two months, after which the protection order would lapse if not complied. No determination was made regarding the validity of the marriage itself, and the petition was disposed with the protective orders.

Issues considered

  • Whether adult petitioners can be restrained from cohabiting and marrying by any party, including family members.
  • Whether a permanent injunction and police protection can be granted without notice to private respondents.
  • Whether the petitioners must register their marriage within a specified period as a condition for continued protection.

Subjects

  • permanent injunction
  • protection order
  • adult marriage
  • interference
  • marriage registration

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari
Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P.
and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
