Allahabad High Court

NISHA GOND AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

Adult petitioners are free to live together and marry, and the court may grant a protection order subject to registration of the marriage within two months.

Summary

The petitioners, Nisha Gond and another, filed a writ petition seeking a protection order to prevent the respondents and family members from interfering in their marital life and to obtain police protection. They submitted school certificates and a marriage registration application to demonstrate that they are adults and have married of their own free will. The court, relying on Supreme Court precedents such as Gian Devi and Lata Singh, held that adult individuals have the right to cohabit and marry without parental or third‑party interference. Accordingly, the court issued a protection order directing the senior police officer to provide immediate security and conditioned the order on the petitioners registering their marriage within two months. If registration is not completed, the protection order will lapse, and the court clarified that it is not passing any judgment on the validity of the marriage.

Issues considered

  • Whether adult petitioners can be barred from cohabiting or married life by family members or private respondents.
  • Whether a protection order can be issued without notice to the private respondents.
  • Whether the court can condition the protection order on timely registration of the marriage.

Subjects

  • adult marriage
  • protection order
  • family interference

Court No. - 75
                 HON'BLE DR. GAUTAM CHOWDHARY, J.

Gian Devi v. The Superintendent, Nari
Niketan, Delhi and others, (1976) 3 SCC 234; Lata Singh v. State of U.P.
and another, (2006) 5 SCC 475; and Bhagwan Dass v. State (NCT of Delhi),
(2011) 6 SCC 396, which have consistently been followed by the Supreme
Court and this court, as well as of this Court in Deepika and another v. State
of U.P. And others, 2013 (9) ADJ 534. The Supreme Court in Gian Devi
                                    (supra) has held as under:

"Whatever may be the date of birth of the petitioner, the fact
remains that she is at present more than 18 years of age. As the
petitioner is sui juris no fetters can be placed upon her choice of
the person with whom she is to stay, nor can any restriction be
imposed regarding the place where she should stay. The court or
the relatives of the petitioner can also not substitute their opinion
or preference for that of the petitioner in such a matter."

(2006) 2 SCC 578 and (2008) 1 SCC 180 Seema (Smt.) Vs Ashwani

                                                                                             (Dr. Gautam Chowdhary,J.)
