Allahabad High Court

SUSHIL KUMARversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

If the petitioner has locus to file objections in the patta allotment proceedings, the objection must be considered by the respondent.

Summary

The petitioner, Sushil Kumar, filed a writ petition challenging the objection he raised in the allotment of a patta, seeking a declaration that he has the locus to file such objections. The respondents, the State of Uttar Pradesh and two others, contended that the petition merely seeks a decision on the petitioner's locus to object. The Court examined the petitioner's claim that he possesses the requisite standing to raise objections in the patta allotment process. No substantive evidence was presented on the merits of the objection itself. The Court held that if the petitioner indeed has locus standi, the objection must be considered by the concerned respondent. Consequently, the writ petition was disposed of without further order.

                                                   HON'BLE SAURABH SHYAM SHAMSHERY, J.

                                    1. None appears of behalf of the petitioner.

                                    3. Learned counsel for the respondent submits that present writ petition is
filed to decide objection filed by the petitioner, if he has locus to file
                                    objections.

                                    5. Considering the above submissions and averments of writ petitioner,
this writ petition is disposed of that in case petitioner has locus to file
objections in the proceedings of allotment, the same be considered by the
                                    concerned respondent.

                                                                                (Saurabh Shyam Shamshery,J.)
