Allahabad High Court

SEWARAMversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The petition is disposed, with the respondent bank ordered to provide the loan account details and contract and to fix monthly instalments, following the coordination bench order.

Summary

Sewaram filed a writ petition challenging the recovery proceedings of a loan. The parties agreed that the petition could be disposed in line with the coordination bench order in Baijanth v. State of U.P. (RIT‑C No. 10013/2026) dated 22‑07‑2026. The court considered the limit of recovery under the loan contract, referring to the precedent set in Anjani Kumar v. District Officer, Raebareli (RIT No. 1793 (MB)/2008). An interim order in a related special appeal (No. 1018/2026) was also noted. The court directed the respondent bank to furnish the loan account details and a copy of the contract and to fix monthly instalments. Accordingly, the writ petition was disposed.

Issues considered

  • What is the appropriate limit of recovery under the loan agreement?
  • Whether the writ petition should be disposed in accordance with the coordination bench order in Baijanth v. State of U.P.?
  • Whether the respondent bank must provide loan account details and the contract to the petitioner.
