Holding
The Court partially allowed the writ petition, directing the release of the claim amount in accordance with the earlier judgment.
Summary
The petitioners, Mohd Afjal and another, filed a writ petition seeking the release of the entire claim amount awarded by the Railway Claims Tribunal. The claim had already attained finality by a prior judgment of this Court dated 10 September 2026 in Writ‑C No.27617 of 2026 (Ram Naresh Singh & 5 Ors. Vs. Union of India). The present petition was found to be identical in nature to that earlier case. Relying on the precedent, the Court held that the claim amount should be released, but only to the extent permissible under the earlier judgment. Consequently, the writ petition was partially allowed, directing the respondents to comply with the earlier order. The judgment was delivered by Hon’ble Justice Rohit Ranjan Agarwal on 1 October 2026.
Issues considered
