Allahabad High Court
RITU DEVIversusSTATE OF U.P. AND 6 OTHERS
- Decided
Holding
The court held that the petitioner must first file an application under the Uttar Pradesh Panchayat Raj (Maintenance of Family Registers) Rules, 1970, and therefore the writ petition is dismissed pending such application.
Summary
The petitioner, Ritu Devi, filed a writ petition seeking the inclusion of her name in the family register maintained under the Uttar Pradesh Panchayat Raj system. The High Court observed that the appropriate remedy is to file an application under the Uttar Pradesh Panchayat Raj (Maintenance of Family Registers) Rules, 1970. The court directed the petitioner to pursue that administrative procedure to ventilate her grievance. No substantive adjudication on the merits was made. Consequently, the writ petition was disposed, granting the petitioner liberty to file the requisite application, which the respondents must expedite.
Issues considered
- Is a writ petition maintainable for the inclusion of a name in the family register?
- Should the petitioner first approach the authority under the Uttar Pradesh Panchayat Raj (Maintenance of Family Registers) Rules, 1970 before seeking judicial relief?
