Allahabad High Court
MAHENDRAversusUNION OF INDIA AND ANOTHER
- Decided
- Bench
- ROHIT RANJAN AGARWAL
Holding
The court partially allowed the writ petition, confirming the release of the claim as per the earlier judgment.
Summary
The petitioner sought release of the entire claim awarded by the Railway Claims Tribunal. The High Court noted that the issue of release had already attained finality by its earlier judgment in Ram Naresh Singh and 5 Ors. Vs. Union of India dated 10 September 2026. Accordingly, the present writ petition was partly allowed in accordance with that prior judgment. The court directed that the relief sought be granted to the extent consistent with the earlier decision. No new substantive legal question was entertained beyond confirming the earlier order.
Issues considered
- The claim awarded by the Railway Claims Tribunal can be released after the earlier judgment in Ram Naresh Singh and 5 Ors. Vs. Union of India has attained finality.
