Allahabad High Court

NAVIRASOOLversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The respondent must first decide the impleadment application and then expeditiously dispose of the pending proceedings under the applicable statutes.

Summary

The petitioner, Navirasool, filed a writ petition seeking a direction to the State of Uttar Pradesh and other respondents to promptly conclude the pending proceedings of Case No. 396/1996 under Section 198(4) of the Uttar Pradesh Zila Adalat (U.P.Z.A.) and Land Revenue Act, as well as to decide an impleadment application filed on 20‑03‑2020. The respondents argued that the impleadment application and the main case remain undecided and should be resolved without further delay. The learned Standing Counsel emphasized the need for a swift decision on both matters. The Court, after hearing counsel, observed that the respondent must first decide the impleadment application and thereafter dispose of the pending proceedings expeditiously in accordance with law. Accordingly, the writ petition was disposed with a directive to the respondent to take all necessary steps for a prompt resolution.
